Membership Terms & Conditions​
1. Instruction and Membership Benefits
The provider, MVPR Studio, agrees to deliver competent instruction, supervised by qualified personnel trained in appropriate procedures and techniques. The Member agrees to purchase this instruction and acknowledges that the membership benefits outlined in this Agreement are exclusively for their use and are non-transferable.

2. Class Participation
The Member acknowledges and agrees to participate in the selected program(s) and classes, collectively referred to as the “Classes.”

3. Compliance with Rules
I will comply with all the rules and regulations of MVPR Studio while attending Classes, whether at MVPR Therapy premises, online, or any other location where Classes may be held.

4. Member Responsibilities
The Member agrees to comply with all gym rules and regulations, maintain personal health insurance, and notify MVPR Studio of any medical conditions or injuries that may affect their ability to participate in classes.

5. Membership Term
I acknowledge and agree that I will maintain membership and pay the applicable fees for a minimum Term. I agree that I will be liable for fees for the entire Term of this agreement in the amounts as stated herein regardless of usage or any change of circumstance, except as specifically allowed in this Agreement.

6. Membership Renewal
MVPR Studio will send you a notice of renewal before the initial Term expiry date. Upon renewal of the Term, MVPR Studio reserves the right to increase your membership rate to the then current rate.

7. Payment
EFT Authorization: I, The Member, authorize MVPR Studio, to transfer electronic funds on a recurring basis from the checking, savings, or credit card account specified above for my membership with MVPR Studio. This authorization is to remain effective until MVPR Studio has collected for all charges assessed in connection with the terms and conditions of this Agreement, and shall continue where my membership with is renewed.

8. Next Payment
I understand my next payment is due on the same day of each calendar month, subject to any Hold Periods that may apply.
9. Late Payments
I will pay a service charge of $20.00 for any payments 10 days past due. If there are three payments which are 10 days past due during the period of this Agreement, I agree to pay the remaining balance of the Agreement in full, in addition to any and all recovery charges incurred.
10. Overdue Accounts
An account with overdue payments will be considered in default status after 60 days. Facility access will be terminated by this date, if not before.

11. Unprocessed Payment
I hereby agree that if MVPR Studio, is unable to process my payment from the designated account provided by me, MVPR Studio is permitted to use any of the other accounts information provided as many times and as often as needed to replace the unpaid payments and service charges as explained in this Agreement.

12. Termination for Default
In addition to any rights and remedies it may otherwise have, MVPR Studio may terminate this Agreement upon ten (10) days' written notice to me if I fail to comply with my obligations under this Agreement and do not cure any such failure within ten (10) days after receiving notice of such failure.

13. Membership Holds
Members may put their account on hold for a minimum period of seven (7) days, up to a maximum of forty-five (45) days for reasons of injury, illness, or vacation (the “Hold Period”). Payments will be paused during the Hold Period. When the Hold Period is over, the next bill date will be pushed out by the same number of days as the applicable Hold Period. Members with a twelve (12) month membership term may put their membership on hold a maximum of three (3) times during the Term. Any other requests for a membership hold shall be made at the sole discretion of MVPR Studio.

14. Cancellation of Membership
I understand this Agreement may be cancelled by me at any time by providing at least 30 days prior notice of the cancellation date (email is acceptable) and by paying an administrative cancellation fee equal to $25 (the “Cancellation Fee”), plus $50 for each remaining month of the Agreement Term, up to a maximum payment of $250. All discounts given will not be considered in the calculation of the cancellation fee. Email notice may be sent to: membership@mvprstudio.co.

15. Personal Training
In the event you have Personal Training sessions with MVPR Studio, the cancellation policy for Personal Training sessions is as follows:
With the exception of any cancellation rights arising under the consumer protection legislation in the province in which the Facility is located, which are set out above if applicable, if you wish to cancel this Agreement prior to the expiry of the Binding Period a cancellation fee equal to twenty (20%) of the Total Amount Payable during the Binding Period, as shown above, will apply (plus applicable taxes). Unused Sessions will be available for use until expiry as noted in Section 6 above, but will not be refunded under any circumstances. If a cancellation fee applies in accordance with the terms of this Agreement, the cancellation fee must be paid in full before the cancellation will be processed.
16. Obligation to Pay
Failure to attend the Classes does not relieve me of the obligation to pay the full membership fee for the program in which I am currently enrolled.

17. Limitation of Liability
MVPR Studio and its employees, contractors, and agents are not liable for any injury, loss, or damage that may occur during participation in any class, program, or use of facilities. Members participate at their own risk.

18. Indemnification
The Member agrees to indemnify and hold MVPR Studio harmless from any and all claims, demands, or causes of action arising out of or in connection with the Member’s participation in any class or program.

19. Refund Policy
Except as specifically allowed in this Agreement, no refunds will be issued for any membership fees, including but not limited to cancellation fees, hold periods, or any unused portion of a membership.

20. Dispute Resolution
In the event of any dispute arising out of or in connection with this Agreement, the parties agree to attempt to resolve the dispute through mediation before commencing any legal proceedings. If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.

21. Emergency Contact
The Member agrees to provide MVPR Studio with up-to-date emergency contact information and authorizes MVPR Studio to contact this person in the event of an emergency.

22. Change of Terms
MVPR Studio reserves the right to update the terms and conditions of this Agreement with 30 days' written notice to the Member. Continued use of membership benefits after such notice constitutes acceptance of the updated terms.

23. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
24. Post-Class Stay Limit
Members are required to leave the premises within 30 minutes after the conclusion of their scheduled class. This policy is in place to ensure the smooth operation of subsequent classes and maintain an orderly environment.

25. Restricted Areas
The Personal Training area is exclusive to personal training clients only. Members not enrolled in personal training sessions are not permitted to enter or use the Personal Training area.

26. Respect and Noise Levels
As MVPR Studio operates on a "clinic-first" principle, all members are expected to maintain a respectful demeanor and keep noise levels to a minimum while walking to and from the gym space. This is to ensure a conducive environment for all clients receiving treatment in the clinic.
27. Data Privacy
MVPR Studio is committed to protecting the privacy of personal information of our customers. We make every effort to ensure that the information you share with us is recorded accurately, retained securely and in accordance with applicable privacy laws, and used only according to your wishes. We collect personal details necessary to communicate with you and manage our ongoing business relationship with you. 28. Right of Cancellation
Pursuant to consumer protection laws, you may cancel this Agreement from the day you enter the Agreement until 10 days after you receive a copy of this Agreement. You do not need a reason to cancel. If you cancel this contract, MVPR Studio has 30 days to refund your money. To cancel, you must give notice of cancellation in writing to:

You must give notice of cancellation by a method that will allow you to prove that you gave notice, including registered mail, electronic mail, facsimile or personal delivery. If you send the notice of cancellation by registered mail, electronic mail, or facsimile, it doesn't matter if the seller receives the notice within the required period as long as you sent it within the required period.

29. Guest Policy
Members may bring guests into the gym for classes with prior approval from MVPR Studio. Guests must complete a waiver form and pay a guest fee of $25 per visit for classes. Members are responsible for ensuring their guests comply with all gym rules and regulations.
30. Facility Maintenance and Closure
MVPR Studio reserves the right to temporarily close the facility for maintenance, repairs, or special events. Members will be notified in advance of any closures. Membership fees will not be prorated or refunded for such closures.

31. Health and Safety
Members are required to inform MVPR Studio of any pre-existing health conditions or injuries that may affect their ability to safely participate in classes or use the facilities. Members should consult with a healthcare provider before beginning any new exercise program. MVPR Studio is not responsible for any health issues that arise from participation in gym activities.

32. Use of Equipment
Members agree to use all gym equipment as instructed and follow all safety guidelines. Any damage to equipment resulting from misuse will be the financial responsibility of the member. MVPR Studio reserves the right to charge members for the cost of repair or replacement of damaged equipment.

33. Photography/Video Release
Participants involved in any activities offered by MVPR Studio may be photographed or videotaped while on MVPR Therapy/MVPR Studio premises. The undersigned hereby consents to the use of these photographs and/or videos without further consent, notice or compensation, for use by MVPR Studio on its website, social media accounts or in any editorial, promotional or advertising material on any media produced and/or published by MVPR Studio.

34. Prohibited Activities
The following activities are strictly prohibited within the gym: smoking, alcohol consumption, drug use, inappropriate behavior, and harassment of other members or staff. Violations of this policy may result in immediate termination of membership without refund.

35. Cubicle Space and Personal Belongings
Cubicle spaces are available for daily use only. Members must remove all personal belongings from cubicles after each visit. MVPR Studio is not responsible for lost, stolen, or damaged personal items. Unclaimed items will be held in lost and found for 30 days before being disposed of.
36. Receipt of Agreement
I acknowledge receiving a copy of this Agreement.

37. Understanding and Age Confirmation
I understand my rights and obligations as stated above. By signing this Agreement, I confirm that I am at least 18 years old OR that I have obtained consent from my parent or legal guardian if I am under 18. I acknowledge that I have read and understood this release and waiver of liability and that by signing, I waive certain legal rights, including the right to claim damages that I or my heirs, executors, administrators, successors, or assigns may have against MVPR Studio.
For participants under 18, I affirm that I have parental or legal guardian consent for participation and accept full responsibility for compliance with the terms of this Agreement.
